1. TERMS OF AGREEMENT
(a) Terms of Agreement. Joyple Australia offers you the opportunity to play its multiplayer online computer game 'Mixmaster Online,' subject to your acceptance of all the terms and conditions outlined in this Agreement and your compliance with the posted Rules of Conduct. By using Mixmaster Online, you agree to abide by these terms and conditions and the Rules of Conduct. To confirm your agreement, you must create an account on the Mixmaster service. If you do not agree with these terms and conditions, you are not permitted to register and play Mixmaster Online. If you have any questions about these terms and conditions or the Rules of Conduct, please contact a customer service representative at Joyple Australia.
(b) Amendments. Joyple Australia reserves the right to amend this Agreement or modify the Rules of Conduct at its sole discretion. Any changes will be posted on our website (http://mixmasteronline.com.au OR http://playmixmaster.com OR https://joyplegames.com). Amendments to the Agreement will take effect seven (7) days after being posted, while modifications to the Rules of Conduct will take effect immediately. Your continued use of Mixmaster Online after the effective date of any amendments signifies your acceptance of the changes. We recommend checking this Agreement and the Rules of Conduct periodically to stay updated on any modifications.
2. OWNERSHIP
All rights and title to the Program and the Service, including but not limited to user accounts, titles, computer code, themes, objects, characters, character names, stories, dialogue, catch phrases, locations, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, any related documentation, 'applets' incorporated into the program, transcripts of chat rooms, character profile information, recordings of games played on the program, and the program client and server software, are the exclusive property of Joyple Corporation. Users are strictly prohibited from modifying, publishing, transmitting, participating in the transfer or sale, creating derivative works, or exploiting in any way the content contained on Joyple Australia (including downloadable content provided by the website) without the express written permission of Joyple Australia. In cases where permitted copying, redistribution, trademark usage, or copyrighted material is involved, no alterations or deletions of author attribution, trademarks, legends, or copyright notices shall be made. Users are granted the right to download copyrighted material from Joyple Australia solely for their personal use.
3. DESCRIPTION OF SERVICE
Joyple Australia offers Mixmaster Online, an item-based online role-playing game service (the 'Service'), which can be accessed through our website currently located at www.playmixmaster.com (the 'Website'). Please note that Joyple Australia reserves the right to change the URL address of the Website at any time and without prior notice. To utilize the Service, you will be required to download and install software provided by Joyple Australia from the Website (the 'Software'). It is necessary for anyone wishing to use the Service to create an account with Joyple Australia (the 'Account'). Please be aware that Joyple Australia does not provide Internet access, and you will be responsible for any fees associated with your own Internet connection. The Website, accessible at mixmasteronline.com.au, is an integral part of the Service, and your use of the website is subject to the same terms and conditions outlined in this User Agreement and the Rules of Conduct.
4. ACCOUNT
(a) Eligibility: Accounts are available to all individuals. To use the service, you must complete the registration process, create an account in your name, and accept full responsibility for all obligations under this agreement. Those who have completed these steps and maintain their account in good standing are referred to as 'Members' in this agreement. By clicking the 'Register' button, the registered user of an account may access and use the account. Each account is intended for the personal use of one person, and you are responsible for all activities conducted through your account.
(b) Account ID: When opening your account, you must choose a unique name (your 'Account ID' or 'Username') to identify yourself to Joyple Australia. Your Account ID should not infringe upon any third party's trademark rights, copyrights, or other proprietary rights, mislead other players to believe you are an employee of Joyple Australia, or be deemed vulgar or offensive at Joyple Australia's sole discretion. Joyple Australia reserves the right to delete or alter any Account ID or terminate any license granted herein, for any reason, including suspected or actual infringement of any intellectual property rights. You are solely liable for all activities conducted through your Account or under your Account ID.
(c) Ownership of Account: By agreeing to the User Agreement, you acknowledge that you do not own the account you use to access the service, the characters stored on Joyple Australia servers, the items stored on these servers, or any other data associated with the servers and accounts. The account you create is necessary for accessing the service, and the fees you pay are for continued access to the service.
(d) Character Name: To use the service, you must create a character and choose a name (your 'Character Name') to identify your character to other Members. Your Character Name should not infringe upon any third party's trademark rights, copyrights, or other proprietary rights, mislead other players to believe you are an employee of Joyple Australia, or be deemed vulgar or offensive at Joyple Australia's sole discretion. Joyple Australia reserves the right to delete or alter any Character Name or terminate any license granted herein, for any reason, including suspected or actual infringement of any intellectual property rights.
(e) Passwords: When opening your Account, you must select a password. You are responsible for maintaining the confidentiality of your password and for any harm resulting from its disclosure or use by any person to gain unauthorized access to your Account and Account ID. Joyple Australia will never ask for your password offline or online, except as part of the log-on process.
(f) Former Members: Members whose Accounts have been terminated by Joyple Australia may not access the Service in any manner or for any reason, including through any other Account, without the express written permission of Joyple Australia.
(g) Related Accounts: If Joyple Australia terminates an Account, any other Accounts that share the same member name, email address, Internet Protocol address, or credit card number with the terminated Account may also be terminated.
(h) Downloads: Downloads of Joyple Australia programs should only be obtained from our approved website or authorized mirror sites. Joyple Australia will not be responsible for any harm resulting from downloads from unauthorized sources.
(i) Account Blocking/Banning: Joyple AU reserves the right to temporarily or permanently block or ban an account without prior notice.
5. SERVICE FEE
(a) Mixmaster Online is primarily a free-to-use game service.
(b) Designated paid information and services are governed by the user agreement and Joyple Australia's paid service policies.
(c) Joyple Australia exclusively owns all paid services in Mixmall (http://mixmasteronline.com.au/mixmall). Users who purchase certain contents gain item usage rights on the web within a specific time period.
(d) Paid items owned by users cannot be sold or transferred to others for real money without Joyple Australia's consent. Free items and gifted items from other users are non-refundable.
(e) The usage period of game items is limited to the duration of the service. If Joyple Australia terminates the Mixmaster Online game service, the item usage rights will cease along with the service termination.
(f) Only the unused portion of game currency (cash points) is refundable. If you have purchased an item, you cannot obtain a refund for the item even if it remains available in the game.
(g) In the event of a breach of this agreement causing damage to Joyple Australia, you forfeit your rights and are wholly responsible for all costs, including attorney's fees and other expenses incurred.
(h) Charge Back Policy: Cash Points can only be charged back within 7 days of the purchase if they have not been used. To request a chargeback, contact us at game@playmixmaster.com, and the money will be refunded within 7 business days, with the corresponding Cash Points removed from your account. If the Cash Points have been partially or fully utilized, a chargeback is not possible.
(j) Dispute Resolution: If you open a dispute in any of our payment options, Joyple AU reserves the right to block your account until the case is resolved to ensure security and prevent fraudulent activity on the charge system.
6. OFFICIAL SERVICE
Joyple Australia provides Mixmaster Online exclusively through its official website. You agree to play Mixmaster Online only as offered by Joyple Australia at the designated Web Site and not through any other means. You also agree not to create or provide any other means for others to play Mixmaster Online, such as server emulators. You are prohibited from using any unauthorized hardware, software, or third-party tools that may give you an unfair advantage or influence your use of the Service, including the use of automated programs or "bots." You acknowledge that you do not have the right to create, distribute, or use any software programs, utilities, applications, emulators, or tools derived from or created for Mixmaster Online, except as expressly permitted by this Agreement. Engaging in actions that impose an unreasonable or disproportionate load on the game's infrastructure is also prohibited. Selling or auctioning Mixmaster Online accounts, characters, items, in-game currency, or copyrighted material is strictly prohibited.
(!) Please note that for security reasons, Joyple Australia reserves the right to retain the names and addresses of its members within its internal administration, limited to contractual or legal cases.
7. PRIVACY
(!) You can review our Privacy Policy terms on the designated webpage.
8. LAWS & COPYRIGHTS
(a) Joyple AU holds an exclusive license to operate the MixMaster Service in English and Portuguese (PT-BR) languages. Any other servers operating Mixmaster Online are considered illegal and in violation of Joyple AU's privacy rules and policies. If you come across any such servers, please report them to us at game@playmixmaster.com, and we will take appropriate legal actions.
10. INTERRUPTION OF SERVICE
(a) Joyple Australia reserves the right to periodically interrupt the Service, whether on a regularly scheduled basis or otherwise, with or without prior notice in order to perform maintenance tasks.
(b) You acknowledge that the Service may be interrupted due to reasons beyond Joyple Australia's control, and Joyple Australia cannot guarantee uninterrupted access to the Service or your Account. Joyple Australia shall not be held liable for any interruptions, delays, or failures to perform that result from any causes beyond its control.
(c) Joyple Australia is not obligated to reimburse any expenses incurred by users due to Service interruptions caused by the circumstances described in paragraphs (a) or (b).
11. WARRANTY DISCLAIMER
Joyple Australia provides the Service, Software, Account, Mixmaster Online game, and all other services on an "as is" basis, and explicitly disclaims all warranties or conditions, whether written or oral, express, implied, or statutory. This includes, but is not limited to, any implied warranties of title, non-infringement, merchantability, quiet enjoyment, accuracy, or fitness for a particular purpose. Joyple Australia does not guarantee continuous, error-free, secure, or virus-free operation of the Service, Software, your Account, or Mixmaster Online. Please note that some states may not allow the disclaimer of implied warranties, so the above disclaimer may not apply to you. This warranty provides you with specific legal rights, and you may also have other legal rights that vary from state to state.
You agree to indemnify, defend, and hold harmless Joyple Australia, its subsidiaries, affiliates, directors, officers, shareholders, employees, agents, Service Provider Customers, clients, and contractors from any loss, claim, demand, cost, and expense (including reasonable legal fees) asserted by any third party arising from your use of the Service, your Content, your violation of the Terms of Agreement, or your infringement of any rights of another user. Joyple Australia reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, which does not excuse your indemnity obligations.
14. TERMINATION
In the event of termination of your Account or this Agreement:
(1) You will not be entitled to any refund or proration of fees.
(2) You will lose any developed avatars or accumulated items, and you will not have the right to transfer, sell, or assign avatars or items to anyone else.
(3) You may not access the Service in any manner or for any reason, including through any other account. If an account is terminated, Joyple Australia may terminate any other accounts sharing the same member name, phone number, email address, internet protocol address, or credit card number with the terminated account.
(4) Joyple Australia may terminate this Agreement (including your Software license and your Account) immediately and without notice if you breach this Agreement, willfully infringe any third-party intellectual property rights, provide unverifiable or inauthentic information, or engage in inappropriate gameplay, chat, or any activity that, in Joyple Australia's sole discretion, is deemed inappropriate or violates the spirit of Joyple Australia as described in the Rules of Conduct. In the event of such termination, you will lose access to your Account for the remaining prepaid period without any refund.
15. GENERAL PROVISIONS - Additional duties applied to all players:
Under no circumstances should you use offensive language, mistreat other players, or engage in disruptive behavior. This includes refraining from using other languages with offensive words directed towards players. Please note that violations of these rules may result in penalties such as placing your character in the consolation map or account banning, which restricts any activity until the ban is completed based on the offense committed.
(a) No Disruptive Behavior: Trolling to the point of annoyance is prohibited.
(b) No Offensive Language Towards Others/GM.
(c) No Racism.
(d) No Scamming.
(e) No Begging.
(f) No Spamming Chat Window.
(g) No Player Harassment.
(h) No Whisper Spam.
(i) No Communicating with a GM using rude language or spamming.
(j) No Bug Abuse.
(k) No Kill Stealing: Interfering with a player who has already begun killing a monster is considered kill stealing.
(l) No Use of Auto Programs in the game.
(m) Do not make false and unfounded accusations against staff members.
(n) Joyple Australia is not responsible for transactions made outside the game or involving real money with third parties. The responsibility for exchanging items/henchs/gp rests entirely with the player.
(o) When sending or exchanging items with another player, you confirm that you are "donating" the items sent through the trade. In case of transaction problems, Joyple Australia is not responsible for refunding the items. Only engage in trades if you are certain.
(p) Modifications to the Game Client are not allowed. No support will be provided for in-game problems related to client modification.
(q) Changing the game client's files or using any third-party software is strictly prohibited. Violation of this rule may result in a 30-day suspension of the account (for file modification) or permanent account suspension (for use of third-party software) without prior notice. The punishment may be subject to change or revocation by team members.
(r) Users who modify game client files will receive a warning. Continued file modification after receiving a warning will result in the following punishments: 2nd time - 7 days ban, 3rd time - 30 days ban, 4th time - permanent account suspension. The punishment can be changed or revoked by team members without prior notice.
16. NOTICE
Notices can be sent to you or Joyple Australia via email or regular mail. The Service may also provide notification of changes to the Terms of Agreement or other matters related to the Service by displaying notices or links on the Service. Additionally, a permanent direct link to the verified terms should be available for users to access at any time.
17. VIOLATIONS
Please report any violations of the Terms of Agreement to our compliance department via email.
By agreeing to these Terms of Agreement, you confirm that you have read and understood them and agree to be bound by all of their terms.
18. ADDITIONAL CLAUSES
Bug Reporting Rewards Clause:
1. Bug Reporting:
1.1. Players are responsible for reporting any bugs, glitches, or inappropriate behavior encountered during the use of the online MMORPG game ("the Game").
2. Rewards for Bug Reporting:
2.1. The administrative team of the Game reserves the right to offer rewards to players who report bugs based on the severity and impact of the reported bug.
2.2. Rewards will be determined by the administrative team, taking into consideration the nature of the bug, its complexity, and potential impact on the game.
3. Criteria for Rewards:
3.1. The administrative team will evaluate each bug report based on predefined criteria, including but not limited to:
3.1.1. Severity of the bug;
3.1.2. Impact on game performance;
3.1.3. Originality of the report.
4. Types of Rewards:
4.1. Rewards may include, but are not limited to:
4.1.1. In-game virtual currency;
4.1.2. Exclusive items;
4.1.3. Recognition in the game community.
5. Decisions of the Administrative Team:
5.1. Decisions of the administrative team regarding bug reporting rewards are final and not subject to appeal.
5.2. The administrative team reserves the right to modify, suspend, or terminate the bug reporting rewards program at any time without prior notice.
6. Integrity of Reporting:
6.1. Players are encouraged to report bugs ethically and honestly.
6.2. False, misleading, or malicious reports may result in disciplinary actions, including exclusion from participation in the rewards program.
By using the Game, players agree to comply with the terms of this clause and acknowledge that participation in the bug reporting rewards program is subject to conditions set by the administrative team.

(1) You will not be entitled to any refund or proration of fees.
(2) You will lose any developed avatars or accumulated items, and you will not have the right to transfer, sell, or assign avatars or items to anyone else.
(3) You may not access the Service in any manner or for any reason, including through any other account. If an account is terminated, Joyple Australia may terminate any other accounts sharing the same member name, phone number, email address, internet protocol address, or credit card number with the terminated account.
(4) Joyple Australia may terminate this Agreement (including your Software license and your Account) immediately and without notice if you breach this Agreement, willfully infringe any third-party intellectual property rights, provide unverifiable or inauthentic information, or engage in inappropriate gameplay, chat, or any activity that, in Joyple Australia's sole discretion, is deemed inappropriate or violates the spirit of Joyple Australia as described in the Rules of Conduct. In the event of such termination, you will lose access to your Account for the remaining prepaid period without any refund.
15. GENERAL PROVISIONS - Additional duties applied to all players:
Under no circumstances should you use offensive language, mistreat other players, or engage in disruptive behavior. This includes refraining from using other languages with offensive words directed towards players. Please note that violations of these rules may result in penalties such as placing your character in the consolation map or account banning, which restricts any activity until the ban is completed based on the offense committed.
(a) No Disruptive Behavior: Trolling to the point of annoyance is prohibited.
(b) No Offensive Language Towards Others/GM.
(c) No Racism.
(d) No Scamming.
(e) No Begging.
(f) No Spamming Chat Window.
(g) No Player Harassment.
(h) No Whisper Spam.
(i) No Communicating with a GM using rude language or spamming.
(j) No Bug Abuse.
(k) No Kill Stealing: Interfering with a player who has already begun killing a monster is considered kill stealing.
(l) No Use of Auto Programs in the game.
(m) Do not make false and unfounded accusations against staff members.
(n) Joyple Australia is not responsible for transactions made outside the game or involving real money with third parties. The responsibility for exchanging items/henchs/gp rests entirely with the player.
(o) When sending or exchanging items with another player, you confirm that you are "donating" the items sent through the trade. In case of transaction problems, Joyple Australia is not responsible for refunding the items. Only engage in trades if you are certain.
(p) Modifications to the Game Client are not allowed. No support will be provided for in-game problems related to client modification.
(q) Changing the game client's files or using any third-party software is strictly prohibited. Violation of this rule may result in a 30-day suspension of the account (for file modification) or permanent account suspension (for use of third-party software) without prior notice. The punishment may be subject to change or revocation by team members.
(r) Users who modify game client files will receive a warning. Continued file modification after receiving a warning will result in the following punishments: 2nd time - 7 days ban, 3rd time - 30 days ban, 4th time - permanent account suspension. The punishment can be changed or revoked by team members without prior notice.
16. NOTICE
Notices can be sent to you or Joyple Australia via email or regular mail. The Service may also provide notification of changes to the Terms of Agreement or other matters related to the Service by displaying notices or links on the Service. Additionally, a permanent direct link to the verified terms should be available for users to access at any time.
17. VIOLATIONS
Please report any violations of the Terms of Agreement to our compliance department via email.
By agreeing to these Terms of Agreement, you confirm that you have read and understood them and agree to be bound by all of their terms.
18. ADDITIONAL CLAUSES
Bug Reporting Rewards Clause:
1. Bug Reporting:
1.1. Players are responsible for reporting any bugs, glitches, or inappropriate behavior encountered during the use of the online MMORPG game ("the Game").
2. Rewards for Bug Reporting:
2.1. The administrative team of the Game reserves the right to offer rewards to players who report bugs based on the severity and impact of the reported bug.
2.2. Rewards will be determined by the administrative team, taking into consideration the nature of the bug, its complexity, and potential impact on the game.
3. Criteria for Rewards:
3.1. The administrative team will evaluate each bug report based on predefined criteria, including but not limited to:
3.1.1. Severity of the bug;
3.1.2. Impact on game performance;
3.1.3. Originality of the report.
4. Types of Rewards:
4.1. Rewards may include, but are not limited to:
4.1.1. In-game virtual currency;
4.1.2. Exclusive items;
4.1.3. Recognition in the game community.
5. Decisions of the Administrative Team:
5.1. Decisions of the administrative team regarding bug reporting rewards are final and not subject to appeal.
5.2. The administrative team reserves the right to modify, suspend, or terminate the bug reporting rewards program at any time without prior notice.
6. Integrity of Reporting:
6.1. Players are encouraged to report bugs ethically and honestly.
6.2. False, misleading, or malicious reports may result in disciplinary actions, including exclusion from participation in the rewards program.
By using the Game, players agree to comply with the terms of this clause and acknowledge that participation in the bug reporting rewards program is subject to conditions set by the administrative team.
